Ratio Decidendi

The Petitioners are entitled to withhold or redact parts of the Litigation Funding Documents to the extent that those parts would give a clue to or betray the trend of legal advice received, in accordance with the principles in Lyell v Kennedy and Ventouris v Mountain. The court is not reasonably certain that the privilege claim has been misapplied and will not order further review or inspection. There is no general discretion to withhold inspection of relevant, non-privileged documents on the basis of tactical sensitivity. As to the Magwells Documents, the Petitioners are not required to litigate or pay to obtain documents subject to a lien, and no further order for disclosure is made.
