Ratio Decidendi

A company in liquidation may obtain summary judgment to enforce an adjudicator's decision only if adequate safeguards are in place to protect the respondent's right to repayment in the event of a successful cross-claim or final determination. In this case, the court found that the arrangements between JDC and Henderson & Jones did not contravene the Damages Based Agreements Regulations 2013, and that the security offered by JDC (letter of credit and ATE insurance) was sufficient to protect Erith's interests. Therefore, summary judgment was granted, but a stay of execution was imposed pending provision of the security.
