Procedural Posture

Criminal Appeal / Judgment on Renewed Application for Leave to Appeal Against Conviction and Appeal Against Sentence

  1. 1 Whether the trial judge erred in admitting bad character evidence relating to internet searches
  2. 2 Whether the summing up and jury directions on bad character evidence were adequate
  3. 3 Whether the finding of dangerousness and imposition of an extended sentence was justified

Ratio Decidendi

The evidence of internet searches was properly admitted as relevant to sexual interest in children; the judge's directions to the jury were adequate and there was no arguable basis for challenging the conviction. The finding of dangerousness was justified, but the sentence imposed was manifestly excessive as insufficient reduction was made for the applicant's age and maturity at the time of offending. The appropriate sentence was nine years' imprisonment with a five-year extension period.
