Cityfibre Limited v GCI Network Solutions Limited

Cityfibre Limited v GCI Network Solutions Limited

Clause 5.20 of the NAA applies to any project by GCI to migrate End User Connections, reduce MAN Connections, and vacate Locations, including the IP Core Network Project, regardless of whether connectivity is provided by CityFibre or third parties. CityFibre is entitled to recover costs incurred directly in connection with the implementation of such a project. Clause 5.20 does not preclude GCI from exercising its rights under Clauses 14.7 and 14.8, but GCI's exercise of those rights is subject to the obligation to cooperate constructively and in good faith under Clause 5.20.3.
