Legal Issues
- 1 Whether section 16(1) of the Registration of Deeds Act gives priority to a registered voluntary deed over an earlier but later-registered conveyance for value
- 2 Whether the scheme of priority under section 16(1) applies to volunteers and beneficiaries under a will
- 3 Interpretation of 'according to the right, title and interest of the person conveying such lands' in section 16(1)
Ratio Decidendi
Section 16(1) of the Registration of Deeds Act confers priority on the basis of the date of registration for all deeds affecting land, including voluntary deeds and vesting assents, and is not limited to purchasers for value. The earlier registration of the Assent gives the Beneficiaries priority over the later-registered 1979 Conveyance, regardless of the nemo dat principle or the fact that the Assent was voluntary.
