The court found inconsistencies between Tetronics' evidence to the court and its submissions to the ICC Emergency Arbitrator, amounting to a failure of full and frank disclosure. Although there was a seriously arguable case of fraud and knowledge by the bank, the balance of convenience no longer favoured continuation of the injunction.
