Amazon.com, Inc & Ors v Interdigital VC Holdings, Inc & Ors [2025] EWHC 3170 (Pat) (02 December 2025)

Amazon.com, Inc & Ors v Interdigital VC Holdings, Inc & Ors [2025] EWHC 3170 (Pat) (02 December 2025)

The interim anti-anti-suit injunction (AASI) is continued. There remains a real and sufficient risk, based on InterDigital's prior conduct and equivocation, that InterDigital may seek anti-suit relief in foreign courts to restrain Amazon's pursuit of final RAND relief in the UK. The interests of justice require the continuation of the AASI to protect the jurisdiction of the English court and prevent vexatious or oppressive conduct. The order does not offend comity as it is directed at the parties, not foreign courts, and does not prevent substantive patent infringement proceedings abroad. Clarifications to the order may be made to avoid ambiguity but do not alter its substance.

Procedural Posture

Patents/intellectual Property / Interim Application to Set Aside or Vary Anti Anti Suit Injunction (aasi)

  1. 1 Whether to set aside or continue the interim anti-anti-suit injunction (AASI) granted to restrain InterDigital from seeking anti-suit relief against Amazon's pursuit of final RAND relief in the UK.
  2. 2 Whether there is a sufficient threat or intention by InterDigital to seek anti-suit injunctions in foreign courts to justify continuation of the AASI.
  3. 3 Whether the AASI offends principles of comity or requires clarification.

Ratio Decidendi

Court Disposition

Application to set aside the AASI refused; AASI continued with possible clarifications.

Orders
