Procedural Posture

Jurisdiction Challenge (cpr Part 11) in Patent and RAND Licensing Dispute / Judgment on Jurisdiction Challenge and Forum Non Conveniens Stay

  1. 1 Whether the English court has jurisdiction to determine global RAND terms for licences of InterDigital's patents
  2. 2 Whether service within the jurisdiction was valid under CPR r.63.14
  3. 3 Whether permission to serve out was properly granted under Practice Direction 6B gateways

Ratio Decidendi

Claims for determination of RAND terms for licences relating to UK patents, even if global in scope, relate to property within the jurisdiction and fall within CPR r.63.14 and gateway 11. Service within the jurisdiction was valid, permission to serve out was properly granted, and InterDigital failed to show any alternative forum (arbitration, Switzerland, Delaware) that is clearly and distinctly more appropriate. Undertakings and arbitration offers do not alter the jurisdictional analysis. The English court is the appropriate forum, especially given the competition claims.

Court Disposition

Jurisdiction challenge dismissed; forum non conveniens stay refused

Orders

  • Service within the jurisdiction under CPR r.63.14 upheld
  • Permission to serve out under Practice Direction 6B gateways upheld
