Civil Appeal / Appeal From County Court to Court of Appeal

  1. 1 What is the correct legal boundary between 38 and 39 Simmil Road?
  2. 2 Does the 1935 conveyance define the boundary as the 'red line'?
  3. 3 Has title to the disputed triangle been extinguished by adverse possession?

Ratio Decidendi

Although the 1935 conveyance and plan defined the legal boundary as the red line, the evidence established that the owners of No 39 and their predecessors were in exclusive possession of the disputed triangle from 1935, so that by about 1950 the Huntleys' predecessors' title was extinguished by adverse possession. The present boundary is the green line as found by the judge.
