Beckles, R. v
The trial judge misdirected the jury by failing to properly direct them on the significance of the appellant's reliance on legal advice to remain silent during police interview, and by not instructing them to consider whether the reliance was genuine and reasonable. This misdirection, particularly in light of the European Court of Human Rights finding a violation of Article 6(1) ECHR, rendered the conviction unsafe. The convictions were therefore quashed.
