Ratio Decidendi

The court found that R's injury was caused by one of his parents yanking and twisting his leg between 4.30 pm on 18 December and 5.30 am on 19 December 2013. Both parents were aware of the injury and colluded to conceal the truth. Due to their unreliability, the court could not identify which parent was the perpetrator. Both parents are responsible for R's removal due to their joint cover-up. The father also assaulted the mother on 30 April 2014 as described in her statement.
