Ratio Decidendi

The sums due to the applicants constituted a statutory debt arising under directly effective Community law, enforceable in domestic courts. Such a debt could have been recovered by writ, and interest under s.35A of the Supreme Court Act 1981 is in principle recoverable, notwithstanding that the proceedings were brought by judicial review. The parties treated the Notices of Motion as if s.35A applied, and there was no procedural bar to awarding interest. Interest should run from the date Regulation 2988/95 entered into force (26 December 1995).
