Procedural Posture

Financial Remedy Proceedings / Final Judgment

  1. 1 Extent of wife's entitlement to matrimonial assets given conduct and lack of financial contribution
  2. 2 Application of sharing principle to jointly owned matrimonial homes
  3. 3 Impact of coercive and controlling behaviour on financial award

Ratio Decidendi

The wife's entitlement to the matrimonial assets is reduced to 30% of the combined value of the three properties (Park Street, North Farm, Leicester property) due to her lack of financial contribution and egregious conduct, including coercive control and financial abuse. Sums already taken or transferred overseas by the wife are treated as part of her share. The husband is to pay the wife £750,000 upon her vacating North Farm, and both parties retain their respective non-matrimonial assets. There is a full clean break upon implementation.

Court Disposition

Wife's claim for equal sharing dismissed; reduced award granted based on conduct and lack of contribution.

Orders

  • Park Street and North Farm to be transferred to husband's sole name within 21 days of final order.
  • Wife to vacate North Farm within 28 days of court's order.
