Ratio Decidendi

By majority, section 45 of the Criminal Proceedings etc (Reform) (Scotland) Act 2007 was within the legislative competence of the Scottish Parliament. Its purpose was to reform the summary justice system by increasing the sentencing powers of sheriffs, a matter of Scots criminal law of general application, not special to a reserved matter. The modification was not to a rule special to a reserved matter, and the provision was intended to apply consistently to both reserved and non-reserved matters. Therefore, it did not breach the restrictions in Schedule 4 of the Scotland Act 1998.
