Ratio Decidendi

The Council acted unlawfully in treating the value of job creation as part of the consideration for the purposes of section 123(2) of the Local Government Act 1972. Only elements of commercial or monetary value to the authority can be included in the consideration; social or non-monetary benefits such as job creation cannot be counted. The Council should have sought the consent of the Secretary of State if it wished to accept less than the best monetary consideration.
