The parties intended equal beneficial ownership at the time of purchase, and post-acquisition conduct did not alter that intention. However, the assurance given by the respondent to the claimant that she could remain in the property as long as she wished created a proprietary estoppel, entitling her to remain indefinitely, and no order for sale should be made without her consent.
