Ratio Decidendi

The Court of Appeal held that the evidence established the testator's knowledge and approval of the entire will, not just the legacy to Mrs. Griffin. The judge's suspicion was not justified by the evidence, and the circumstances did not support the conclusion that the testator was deceived or lacked knowledge and approval. The will was duly executed by a testator of full capacity, who initiated the will-making process, provided the forms, and had ample opportunity to read and understand its contents. The appellate court reversed the High Court's order and granted probate of the whole will.

Court Disposition

Appeal allowed; probate granted of the whole will.

Orders

  • Probate of the will in solemn form granted to Michael Fuller as executor.
