Ratio Decidendi

The claimants failed to take reasonable steps to serve the claim form within the extended period, as they could have instructed an agent in KSA much earlier and expedited translations. They also failed in their duty of full and frank disclosure by not informing the court of potential limitation defences and unpaid costs on their without notice applications. As a result, the extensions unjustifiably prejudiced the second defendant's limitation defences. There were no exceptional circumstances or good reasons to justify the extensions, and the orders must be set aside.
