Clause 4 of the Constitution was not validly amended in 2010, and the proper trustees are the President, General Secretary, and Treasurer of the Executive Committee. The Defendants must transfer legal title of SMICC property to the current Executive Committee.

Court Disposition

Claim allowed. Defendants ordered to transfer property and control to the Executive Committee elected in 2021.

Orders

  • First to Fourth Defendants to transfer legal title of SMICC properties to the President, General Secretary, and Treasurer of the Executive Committee forthwith.
  • If Defendants fail to execute transfer within 7 days, a District or Circuit Judge will execute the transfer on their behalf.
