The tribunal did not act perversely in refusing the claimant's applications for postponement, having balanced her right to a fair trial against the respondent's rights and the public interest, and having found insufficient medical evidence and a likelihood of recurrence. The tribunal erred in concluding the respondent lacked constructive knowledge of the claimant's ASD, but was entitled to find that the conduct for which she was dismissed did not arise in consequence of her disability, and that dismissal was justified in any event. The appeal was therefore dismissed.
