The Bank had a legitimate interest and contractual obligation to recover assets allegedly misappropriated by Mr. Ablyazov. Even if it is arguable that the President of Kazakhstan influenced the Bank for a collateral political purpose, the existence of a legitimate purpose precludes a finding of abuse of process. The proceedings are not an abuse, as the Bank's interest is not illegitimate and the consequences of the litigation (damage to Mr. Ablyazov's reputation or assets) are natural results of a legitimate fraud claim.
