Clauses 5, 6, and 7 of Annex A to the 2014 Settlement must be read together: clause 5 deals with availability of the New MSF, clause 6 sets conditions for entitlement to use, and clause 7 imposes a cap. MM is not entitled to have any funds from the New MSF credited to its MVNO account unless it has complied with its Minimum Year to Date Bundle Commitment and its actual usage exceeds that commitment. The maximum credit is the lesser of the excess usage or the MSF Cap minus prior credits. The New MSF cannot be used to meet Minimum Usage Commitment except as provided in clause 8.
