Where a Fast Track claim is struck out for breach of an unless order, each defendant is entitled to fixed recoverable costs under Table 12(B)(2) of PD45, or two-thirds thereof if a litigant in person, subject to assessment under CPR 46.5. The consolidation of claims does not deprive individual defendants of their entitlement to costs. Table 1 interim application costs do not apply to the conclusion of the claim as a whole.
