A whole life tariff is lawful in principle for sufficiently heinous crimes, but ministerial policy must allow for consideration of exceptional circumstances such as exceptional progress in prison. The challenged 1994 policy unlawfully fettered discretion by excluding such consideration, but the 1997 policy remedied this defect. No unlawful increase of tariff occurred as the provisional tariff was neither fixed nor communicated to the applicant.
