The majority held that Article 13(2) of the policy, by its plain wording, entitles the insurer to terminate the policy and all liability under it, including contingent liabilities, upon breach of a condition precedent. This includes the right to retain premiums paid, even if cover is withdrawn for future and contingent claims, but does not entitle the insurer to repayment of claims already paid or to avoid liability for claims that have crystallised prior to termination.
