The Court of Appeal held that although MW could and should have raised the misrepresentation claims in the Main Action and breached the Aldi guidelines by failing to do so, this breach alone did not amount to an abuse of process justifying strike out. There was no significant overlap between the Main Action and the misrepresentation claims, no unjust harassment or oppression to Outotec, and Outotec would in any event have to defend similar claims in respect of other projects. The judge's merits-based evaluation was not plainly wrong and the appeal was dismissed.
