Procedural Posture

Care Proceedings (children Act 1989) / Judgment After Fact Finding Hearing

  1. 1 Did Kyle Bevan inflict fatal injuries on Lola James?
  2. 2 Was Sinead James (the mother) awake and failed to protect Lola during the incident?
  3. 3 Did Kyle Bevan inflict gratuitous violence on the children prior to the fatal event?

Ratio Decidendi

The court found, to a very high level of probability, that Kyle Bevan inflicted fatal, non-accidental injuries on Lola James at about 06:20 on 17 July 2020, and had previously inflicted gratuitous violence on Lola and VH. The mother, Sinead James, was asleep during the fatal incident but was aware of Bevan's abuse prior to the event and failed to protect the children. The findings were based on the totality of lay and expert evidence, which unanimously concluded the injuries were non-accidental and inconsistent with a domestic fall. The threshold for care orders was crossed and the welfare outcome agreed.

Court Disposition

Findings of fact made; threshold crossed; welfare outcome agreed; final care orders to be made at subsequent hearing.

Orders

  • Final care orders to be made placing IY and VH with their maternal grandmother, Nicola James.
  • Supervised contact with the mother and respective fathers ordered.
