X v Y (repayment of overpaid maintenance) [2012] EW Misc 5 (CC) (22 February 2012)

X v Y (repayment of overpaid maintenance) [2012] EW Misc 5 (CC) (22 February 2012)

The court has discretionary power under s.33 Matrimonial Causes Act 1973 to order repayment of overpaid periodical payments in enforcement proceedings following a change of circumstances. The discretion must be exercised by balancing relevant factors for and against repayment. In this case, the factors were evenly balanced, so partial repayment was ordered. The costs of the appeal were awarded to the husband, but not the costs of the original proceedings. Permission to appeal can only be granted by the Court of Appeal as this would be a second appeal.
