Procedural Posture

Commercial Court Application / Application to Strike Out Part of Counterclaim

  1. 1 Does the English Commercial Court have jurisdiction over tort claims for wrongful arrest brought as a counterclaim, given an exclusive jurisdiction clause in the charterparty?
  2. 2 Should the Court decline jurisdiction in favour of the Supreme Court of Gibraltar under the Brussels Convention 1968 (Articles 21 and 22)?

Ratio Decidendi

The tort claims for damages for wrongful arrest are sufficiently connected to the charterparty to fall within the scope of the exclusive jurisdiction clause, engaging Article 17 of the Brussels Convention 1968. Article 21 does not apply as the claims are not the same as those before the Gibraltar court. Article 22 is engaged but discretion should be exercised to retain jurisdiction in England, given the limited risk of irreconcilable judgments, the stage of proceedings, and the parties' choice of forum.

Court Disposition

Application dismissed

Orders

  • The Claimant's application to strike out the tort claims in the counterclaim is dismissed.
  • Directions to be given for further conduct of the matter, parties to seek to agree.
