The Estate Agents Act 1979, as properly construed, requires that where oral representations are requested, the adjudicator (as the effective decision maker) must personally and face to face conduct the hearing of those representations. The procedure adopted by Powys County Council, whereby the investigator hears the representations and the adjudicator only considers a recording or transcript, does not comply with the statutory requirements and is unlawful.
