The property was not held as beneficial joint tenants. The parties intended Richard Ritchie to have a beneficial interest, but not equal to Adassa Ritchie's. Taking into account the discount provided by Adassa Ritchie and the equal contributions to the mortgage, Richard Ritchie is entitled to a one third beneficial interest in the property. Proprietary estoppel does not apply as the alleged representations were not established and there was no detrimental reliance. An order for sale is appropriate, but postponed for six months to allow Richard Ritchie time to make alternative arrangements.
