Mr Shalabayev was not a party or privy to the committal proceedings and had no proper opportunity to contest the issue of ownership of the property. The committal proceedings were not intended to determine his proprietary rights, and his interests were not identical to those of Mr Ablyazov. It would not be an abuse of process or a collateral attack for him to contest the Bank's claim to a charging order in subsequent proceedings.
