Ratio Decidendi

The English court found that Evialis had a good arguable case that the service clause permitted them to sue the insurers in England, but the contract as a whole was governed by Italian law and also contained an Italian jurisdiction clause. Since the Italian proceedings were first seised and involved the same cause of action, Article 27 of the Brussels Regulation required a stay of the English proceedings. There was no sufficient basis for an anti-suit injunction, as the Regulation provides the mechanism for resolving such disputes, and the insurers' conduct was not unconscionable.
