The inspector was entitled to conclude that the landowner's conduct in excluding the public from part of the land on certain occasions (for beer festivals and funfairs) amounted to an overt act asserting the owner's right to exclude, thereby making it clear that public use at other times was by permission. This was sufficient to defeat the claim that use was 'as of right' under section 15(2) of the Commons Act 2006. The inspector did not misdirect himself in law, and the decision to refuse registration was lawful.
