Ratio Decidendi

A dismissal prior to a transfer can be 'connected with the transfer' under regulation 7(1) TUPE even if the particular transfer or transferee was not known or contemplated at the time of dismissal. The Employment Tribunal was entitled to find that the claimant was dismissed to make the business more attractive to a purchaser, and such a reason is connected with the transfer. The ETO defence was not available as the dismissal did not entail changes in the workforce for the ongoing business.
