The Registrar was wrong to require the lessor's land certificate for first registration of the sub-lease; Mr Caswell's application was valid as of 5th April 1962. The register should be rectified to show his sub-lease as of that date, giving him priority over the plaintiffs' transfer. Mr Caswell did not have an overriding interest under Section 70(1)(g) as he was not in actual occupation nor in receipt of rents and profits at the relevant time.
