Rose, Re [1952] EWCA Civ 4 (04 April 1952)
Where a transferor has executed all necessary documents of transfer and delivered them to the transferee, and nothing further remains for the transferor to do, the beneficial interest in the property passes to the transferee, and the transferor holds the legal title as trustee pending registration. The gift is complete in equity, and the property is not to be aggregated for death duty purposes, even though legal title is perfected only upon registration.
