  1. 1 Whether overtime earnings should be included in the calculation of pensionable remuneration under the Local Government Pension Scheme Regulations 1995
  2. 2 Meaning of 'non-contractual overtime' in the context of the regulations

Ratio Decidendi

'Non-contractual overtime' refers to overtime not required by the contract (i.e., voluntary overtime), and such payments are excluded from pensionable remuneration. The mere existence of a contractual rate for overtime does not make the overtime contractual unless the contract obliges the employee to work overtime. The Ombudsman erred in law by including voluntary overtime in pensionable remuneration.
