Ratio Decidendi

There has been a change of circumstances due to the emergence of new legal authorities (Re B and Re B-S) which were not available to the original judge, and which require a more rigorous analysis of alternatives to adoption. The Father’s prospects of success in opposing the adoption are not fanciful and have sufficient solidity to warrant leave. The welfare of the child will not be adversely affected by granting leave. The application for a stay pending ECHR determination is refused as unnecessary.
