Severance of LPA clauses is only necessary where a provision is incompatible with the statutory scheme or would prevent the instrument from operating as a valid LPA. Where donor intention is clear and the defect is immaterial or a mere error in form (e.g., ticking the wrong box), the court should give effect to the donor's intention and direct registration, possibly with a declaration as to meaning and effect. Statements of wishes or preferences, even if relating to provision for others, do not require severance unless they purport to impose binding obligations contrary to the Act.
