An unauthorised person may lawfully perform tasks within the scope of the conduct of litigation for and on behalf of an authorised individual, provided the authorised individual retains responsibility for those tasks. The authorised individual is the person carrying on the conduct of litigation. The judge below was wrong to distinguish between assisting and conducting litigation under supervision; both are lawful if proper arrangements for supervision and delegation are in place.
