Procedural Posture

Libel Claim (defamation) / Application to Set Aside Order Granting Permission to Serve Out of Jurisdiction

  1. 1 Whether England and Wales is clearly the most appropriate forum for the claim under s.9 Defamation Act 2013
  2. 2 Whether the claimant committed material non-disclosure in the without notice application
  3. 3 Whether the claim is time-barred under the Limitation Act 1980 and s.8 Defamation Act 2013

Ratio Decidendi

The claimant failed to show that England and Wales is clearly the most appropriate forum for the claim, given his long-term residence and professional life in Switzerland, the location of the events and witnesses, and the centrality of Swiss law and proceedings. The claimant committed egregious breaches of the duty of full and frank disclosure by failing to disclose his connections to Switzerland and his lack of residence in England. The claim is also time-barred under the single publication rule, and there is no real prospect of defeating a limitation defence. The order granting permission to serve out is set aside and the claim is dismissed for want of jurisdiction.

Order granting permission to serve out of jurisdiction set aside; claim dismissed for want of jurisdiction.
