Ratio Decidendi

Although the presence of ineligible and deceased persons on the voters register renders it not reasonably accurate or credible, the register is not thereby rendered unconstitutional or inconsistent with article 45(a). The Electoral Commission cannot be compelled to compile a fresh register or use a validation process not provided by law. The court's role is to ensure the Commission acts within the law, not to direct its methods. The Commission must, however, take steps to clean the register in accordance with the Constitution and applicable laws, and any person deleted must be given an opportunity to register under the law.
