Ratio Decidendi

The land in dispute, originally vested in Narh Dumanya (also known as Narh Kwame), is distinct from the land vested in William Dumanya. Both were sons of Jonas Dumanya and acquired separate lands. Bertha Sefa is a member of the Dumanya family through Narh Dumanya. However, only the descendants of Narh Dumanya have a legitimate claim to the land in dispute. The Plaintiff, as a descendant of William Dumanya, has no right to claim the land, and his claim is dismissed.

Orders
