Ratio Decidendi

The Applicant is the biological father and, under both statute and customary law, has the right to name the child. The best interest of the child requires the father’s involvement, naming, and access. The Respondent’s denial of these rights is not in the child’s best interest. The court has jurisdiction to order the naming within its premises if necessary. Both parents have equal responsibilities, and the Applicant is entitled to access and must contribute to maintenance and educational expenses.

Court Disposition

Application granted in the best interest of the child.

Orders

  • Respondent to arrange for Applicant to name the child customarily between 18th and 30th October 2022, or alternatively, naming to occur in court between 1st and 18th November 2022 coordinated by ADR Office.
  • Child shall be known and called Tehila Eyram Kudadze; name to be registered per Section 6(4) of Act 560.
