IN THE FAMILY AND JUVENILE COURT ‘C’ AT THE FORMER COMMERCIAL COURT BUILDING, ACCRA HELD ON TUESDAY THE 14TH DAY OF MARCH 2023 BEFORE HER HONOUR HALIMAH EL-ALAWA ABDUL-BAASIT SITTING AS AN ADDITIONAL MAGISTRATE WITH MADAM PHILOMENA SACKEY AND MR. WISDOM ATIASE AS PANEL SUIT NO. A6/351/23 APPLICANT MEMBERS. GIFTY LAWSON AKOTO LANTE VS. EMMANUEL ODENKEY TETTEH WEIJA RESPONDENT Parties Present No Legal Representation for both parties The Applicant on the 14th day of February 2023 filed an Application praying for CONSENT JUDGMENT the following reliefs; a) For an order directed at the Respondent to maintain the issue at Ghc800.00 a month, pay school fees and anything connected to school and medicals. b) Any further order or orders as the Honorable court deem fit. The basis for the Application is that the parties have a child but the Respondent failed to maintain her when she was pregnant including the antenatal and postnatal expenses and only sent the name to be given to the child during naming ceremony but refused to attend with his family. She deposed further that the Respondent has left all the responsibilities of the child on her, hence her Application before this court. DETERMINATION The matter came up for hearing on 2nd of March 2023 and the Court referred the parties to the Court connected Alternative Dispute Resolution (ADR) Centre to attempt an amicable resolution of the Applicant’s reliefs. Following a successful resolution of the dispute, the parties appended their signatures to the Terms of Agreement Terms of Agreement Before the court is an ADR Terms of Agreement dated 23rd March 2023, where the parties agreed on the following; 1. MAINTENANCE: That Respondent shall pay monthly maintenance of Three Hundred Ghana Cedis (Ghc300.00) for the child into Applicant’s Mobile Money Account Number 0559819238 directly from Respondent’s mobile account number 0244707011 on or before the 5th of each month effective April 2023. 2. EDUCATION: The Respondent shall pay the child’s school fees, cost of textbooks and exercise books. 3. HEALTH: That Applicant shall renew the child’s National Health Insurance Scheme (NHIS) Card and the Respondent shall pay medical bills not covered by Health Insurance. BY COURT: The Terms of Agreement dated 2nd March 2023, signed by both parties before the Mediator; MADAM DORIS KOTEY and confirmed by both parties is hereby adopted as Consent Judgment of the parties.
