Ratio Decidendi

The High Court judge, having been made aware of the applicants' interest and pending application, was required to afford them a hearing before determining the mandamus applications. Failure to do so violated the applicants' constitutional right to be heard, rendering the orders of mandamus in the affected constituencies a nullity and subject to being quashed. The Supreme Court exercised its discretion to quash the orders in four constituencies and directed that the applicants be joined and heard in the rehearing.
