HCMA 464/2024 [2026] HKCFI 2085 香港特別行政區 高等法院原訟法庭 刑事上訴司法管轄權 申請終審法院上訴許可之證明書 裁判法院上訴案件2024年第464號 （原沙田裁判法院傳票2022年第6594號） _________________ 有關根據香港法例第484章《香港終審法院條例》第32條申請上訴許可一事 及 有關原訟法庭就該裁判法院上 訴案件於2025年8月12日所作出之決定 _________________ 答辯人 香港特別行政區 訴 申請人 植英傑 _________________ 主審法官：高等法院原訟法庭暫委法官姚勳智 聆訊日期：2026年3月24日 判案日期：2026年3月24日 判 案 書 申請人經審訊後，被裁判官裁定一項「不小心駕駛」罪罪名成立。申請人不服定罪及判刑，提出上訴。本席已於2025年8月12日駁回其上訴，詳情可見於該判案書。 申請理據 申請人現提出動議通知書，要求法庭作出頒令，證明有關案件涉及具有重大而廣泛重要性的法律觀點，包括沒有向下級法院發出調卷令、沒有了解裁判法院在審訊過程中對申請人不公平之處。 申請人進一步書面陳詞指出，裁判官不接納申請人之證供，認為他在切線問題上有多個不同版本，但沒有考慮到證人證供內容的可信性有否疑點，例如證人說他行埋小巴左車尾影相，但呈堂影片沒有這個影像。裁判官亦看過呈堂影片，也看不見兩車有接觸的情況出現，卻叫證人用不同描述方式來描述他的位置，根本就是早就認定兩車有輕微接觸等情況。警方亦沒有到現場調查、拍照，裁判官對現場證據確認不專業，裁判官並不中立、客觀，好比球證明顯看見有犯規的情況卻不予否定，例如本案呈堂片段不能作為兩車曾經有碰撞的證據。既然兩車沒有碰撞情況、沒有損傷，本案是有疑點，要求發出證明書以便申請人可向終審法院提出上訴等等。 答辯人的回應 答辯方指出申請人並沒有要求證明本案件的決定涉及具有重大而廣泛重要性的法律觀點，而只是重複對裁判官就其事實裁定的投訴。答辯方指出裁判官的判決理由非常詳盡，原訟法庭處理上訴時也鉅細無遺地處理了申請人的投訴。 申請人陳述涉及的其實只是對判案書的批評或重複一些定罪上訴時已提出過的論點，申請人的申請並不涉及具有重大而廣泛重要性的法律觀點，並無任何實質嚴重不公平情況，答辯人認為其申請應予被駁回。 本席的考慮 根據香港法例第484章《香港終審法院條例》第32(2) 條： 「除非上訴法庭或原訟法庭（視屬何情況而定），證明有關案件的決定是涉及具有重大而廣泛的重要性的法律論點，或顯示曾有實質及嚴重不公平情況，否則終審法院不得給予上訴許可。」 而法庭在發出證明書前，必須信納案中所涉之法律論點屬「具有重大而廣泛的重要性的法律論點」，「重大」和「廣泛」的重要性屬兩項不同之要求，申請人亦須證明兩項先決條件均被滿足，法院才能發出證明書。 如終審法院亦在Lee Kin Pong v HKSAR [1998] 1 HKLRD 182指出，該論點須至少是「可合理爭辯的」。 誠如答辯方所指出，申請人現在所提出的全為事實裁定的投訴，包括裁判官不應接納證人證供、不應否定申請人的證詞，事實並無碰撞，與及裁判官並不中立等等，可是這些投訴全是涉及裁判官就事實的裁斷，其實在上訴時亦已作考慮及處理，這些事情明顯地並不涉及任何法律觀點，更遑論具有重大而廣泛重要性的法律論點。因此，本席並無基礎可按上述條例的要求而發出證明書，申請人的申請被拒絕。 （姚勳智） 高等法院原訟法庭暫委法官 答辯人：由律政司高級檢控官陳哿弘先生代表 申請人：無律師代表，親自應訊
