The notarial and trustee handling fees as claimed were not testamentary or administration expenses payable out of the estate/assets in the manner asserted; Mr Fu, Fong & Ng, NCB Trustee and NPO acted improperly or without proper authority by representing that the statutory beneficiaries had agreed to pay the claimed sums, thereby instigating unnecessary litigation; accordingly Fong & Ng, NCB Trustee and NPO are liable to pay the wasted costs of the proceedings on an indemnity basis to the administrator and affected parties, taxed if not agreed.
