Procedural Posture

Divorce / Dissolution of Marriage / Interlocutory Application for Injunction/stay of Foreign Proceedings

  1. 1 Whether Hong Kong court has jurisdiction to restrain husband from pursuing dissolution proceedings in Australia
  2. 2 Whether justice requires granting a stay/injunction to prevent prejudice to the Hong Kong petition filed first
  3. 3 Appropriate forum for determination of ancillary relief (maintenance, custody)

Ratio Decidendi

The High Court has jurisdiction and, having balanced the critical considerations, granted a stay: because the wife filed first in Hong Kong, Hong Kong is the natural forum (parties reside and husband earns in Hong Kong), the Australian ground would extinguish the Hong Kong proceedings and thus cause injustice, and the continuance of dual proceedings would impose disproportionate financial and practical burdens on the wife, the husband is stayed from pursuing dissolution in Australia and the wife is directed not to proceed further in Australia.

Court Disposition

Application granted in part: husband stayed from proceeding further in Australia; wife directed not to proceed further in Australia

Orders

  • Husband is stayed from proceeding further in Australia in respect of dissolution of the marriage
  • Wife is directed to proceed no further with any proceedings she has instituted in Australia
